NOTICE REGARDING THE TEXAS DATA PRIVACY AND SECURITY ACT: This Privacy Policy is intended to comply with the Texas Data Privacy and Security Act ("TDPSA"), Tex. Bus. & Com. 6.3 Right to Deletion
You have the right to request that we delete personal data you have provided to us or that we have collected about you, subject to certain exceptions provided by law.
6.4 Right to Data Portability
You have the right to obtain a copy of your personal data that you previously provided to us in a portable and, to the extent technically feasible, readily usable format that allows you to transmit the data to another entity.

6.7 Automated Decision-Making and Profiling (TDPSA § 541.101(a)(6))
What Is Automated Decision-Making?
"Automated decision-making" means:
- Using algorithms, artificial intelligence, or machine learning to process your personal data
- Making a decision about you based solely on automated processing
- That decision has legal effects (affects your rights/access to services) or similarly significant effects (affects your opportunities/benefits)
Controller does not use automated decision-making processes that produce legal effects or similarly significant effects concerning you. We do not:
- ✗ Use AI, algorithms, or machine learning to deny services
- ✗ Use scoring/profiling systems to make final decisions about you
- ✗ Make consequential decisions based solely on automated processing
- ✗ Use automated systems to determine eligibility or access
Our Website operates based on human review and individual assessment of your requests.
7. How to Exercise Your Rights
7.1 Submitting a Request
To exercise any of the rights described in Section 6, you may submit an authenticated request using one of the following methods:

To protect your privacy and security, we may need to verify your identity before fulfilling your request using commercially reasonable efforts. We will not require you to create an account with us solely to submit a rights request.
7.2 Response Timeline
We will respond to your authenticated request without undue delay and no later than 45 calendar days after receipt, consistent with TDPSA § 541.051(c). If reasonably necessary, we may extend this period by an additional 45 days, in which case we will notify you of the extension and the reason for the delay within the initial 45-day period. We will respond to each consumer's request free of charge at least twice per calendar year.
7.3 Appeals Process
If we decline to take action on your rights request, we will inform you of our decision and the reason for denial within the applicable response period. You may appeal our decision by submitting a written appeal to privacy@kaizendp.com with the subject line "TDPSA Rights Appeal." We will respond to your appeal within 60 calendar days of receipt. If we deny your appeal, we will provide you with an online method or written instructions to contact the Texas Attorney General to submit a complaint, as required by TDPSA § 541.053.
7.4 Authorized Agent
As of January 1, 2025, you may designate an authorized agent to submit requests on your behalf. An authorized agent may use a global opt-out technology, such as a universal opt-out mechanism (e.g., Global Privacy Control), on your behalf. We will process such signals in accordance with TDPSA § 541.055(e).
8. Data Security
We maintain reasonable and appropriate administrative, technical, and physical safeguards designed to protect your personal data from unauthorized access, disclosure, alteration, loss, or destruction, in accordance with TDPSA § 541.101(a)(2). These measures are proportionate to the volume and nature of the personal data we collect.
Our security practices include, but are not limited to:
- Encryption of data in transit using industry-standard Transport Layer Security (TLS);
- Access controls limiting personal data access to authorized personnel on a need-to-know basis;
- Regular review of our data security practices and procedures; and
- Contractual requirements imposed on third-party processors to maintain appropriate security safeguards.
However, no method of transmission over the internet or electronic storage is completely secure. While we strive to use commercially acceptable means to protect your personal data, we cannot guarantee absolute security.
9. Data Minimization Commitment
Controller is committed to the principle of data minimization under the Texas Data Privacy and Security Act (TDPSA). We collect personal data only to the extent necessary and reasonable to accomplish the specific, identified purposes disclosed in Section 4 of this Privacy Policy. We retain personal data only for the duration necessary to fulfill those purposes and will securely delete or de-identify personal data that is no longer necessary.
No Indefinite Retention
We do not retain personal data indefinitely for:
- Marketing purposes
- Future contact without your renewed consent
- Building customer profiles or behavioral data
- Data sharing or aggregation with third parties
- Any purpose beyond those explicitly listed above
If you do not engage with Controller for more than 180 days, we will delete your personal data unless you maintain an active service relationship with us.

Controller does not sell, share, or disclose personal data to third parties for any purpose, including marketing, data brokerage, or targeted advertising. We will not discriminate against you for exercising any of your rights under the TDPSA. We will not deny you goods or services, charge you different prices or rates, provide you with a different level or quality of goods or services, or suggest that you will receive any of the foregoing, solely because you exercised your privacy rights.
11. Cookies and Tracking Technologies
Our Website may use cookies, web beacons, pixels, or similar tracking technologies to enhance your browsing experience and to analyze Website usage. These technologies may collect certain information about your device and browsing behavior. You may control the use of cookies through your browser settings.
